An Open Letter on CPS Practices relating to the Nikolayev Family

SACRAMENTO - Assemblyman Donnelly, today, sent the following letter requesting information on CPS practices in the case of Sacramento residents, Anna, Alex and Sammy Nikolayev.

Dear Director Heller,
 
It has come to my attention that along with law enforcement agents, who lacked a warrant, the Child Protective Services Division of the California Department of Social Services recently removed a baby from his parents' home in Sacramento.
 
As a California State Representative I have sworn an oath to defend the Constitution of the United States and of California against all enemies foreign and domestic. 
 
Without question, removing a child from a home simply because the parents seek alternative medical opinions and treatment for their baby is absolutely counter to our Constitution, founding principles and basic tenants of right and wrong.
 
Please explain by what authority this action was taken. Thank you in advance for your prompt and thorough reply. 
 
I hope this will be quickly resolved and will seek steps to ensure this never happens again in our State.
